Acceptable Use Policy

1. Overview

This Acceptable Use Policy ("AUP") defines the permitted and prohibited uses of the BuildBase service ("Service"). This AUP is incorporated into and forms part of our Terms of Service. All users must comply with this AUP at all times.

We may update this AUP from time to time. Continued use of the Service after changes are posted constitutes acceptance of the revised AUP.

2. Intended Use

BuildBase is designed for personal and business project management, including tracking builds, managing bills of materials, budgeting, task management, note-taking, and file storage related to your projects.

3. Prohibited Content

You may not upload, store, transmit, or share any content through the Service that:

• Is illegal under Australian law or the laws of your jurisdiction, including but not limited to content that promotes or facilitates illegal activities.
• Infringes the intellectual property rights of any third party, including copyrights, trademarks, patents, or trade secrets, unless you have the right to use such material.
• Contains child sexual abuse material (CSAM) or any content that exploits or endangers minors in any way. We have zero tolerance for this and will report it to the appropriate authorities.
• Contains or promotes malicious software, including viruses, trojans, worms, ransomware, spyware, adware, or any other code designed to harm or disrupt computer systems, networks, or data.
• Is defamatory, libellous, threatening, harassing, abusive, hateful, or discriminatory based on race, ethnicity, national origin, religion, gender, sexual orientation, disability, or any other protected characteristic.
• Contains obscene, pornographic, or sexually explicit material.
• Promotes violence, terrorism, or extremist ideologies.
• Contains personal information about third parties without their consent (doxxing).
• Is fraudulent, deceptive, or misleading.

4. Prohibited Conduct

When using the Service, you agree not to:

4.1 Security Violations

• Attempt to gain unauthorised access to the Service, other user accounts, or the computer systems and networks connected to the Service.
• Attempt to probe, scan, or test the vulnerability of the Service or any related system or network, or attempt to breach any security or authentication measures.
• Interfere with or disrupt the Service, servers, or networks connected to the Service, including denial-of-service attacks.
• Use the Service to transmit any data or content that contains viruses, trojan horses, worms, time bombs, or other harmful programs.

4.2 System Abuse

• Use automated tools, bots, scrapers, crawlers, or other automated means to access the Service without our prior written consent.
• Reverse-engineer, decompile, disassemble, or otherwise attempt to derive the source code, algorithms, or data structures of the Service.
• Circumvent or attempt to circumvent any storage limits, usage restrictions, rate limits, or other technical measures in the Service.
• Use the Service in a manner that places excessive or disproportionate load on our infrastructure.
• Create multiple accounts to circumvent restrictions, abuse free trial offers, or evade enforcement actions.

4.3 Commercial Misuse

• Resell, sublicence, lease, or otherwise commercially redistribute access to the Service to third parties without our prior written consent.
• Use the Service to operate a competing service or to build a product or service that replicates the core functionality of BuildBase.
• Use the Service for unsolicited marketing, spam, or bulk communications.

4.4 Misrepresentation

• Impersonate any person or entity, or falsely state or misrepresent your affiliation with a person or entity.
• Provide false or misleading information when creating your account or using the Service.

5. Storage & Resource Limits

Your account includes up to 50 GB of file storage. You agree to use storage responsibly and in connection with legitimate project management activities. The following uses of storage are not permitted:

• Using BuildBase as a general-purpose file hosting, backup, or content distribution platform unrelated to project management.
• Storing or distributing pirated content, including software, media, or other copyrighted materials.
• Storing files that exceed the maximum per-file or total account storage limits.

We reserve the right to remove content that violates these storage guidelines and to reduce or suspend storage access if usage patterns indicate misuse.

6. Reporting Violations

If you become aware of any violation of this AUP, please report it to us at [email protected]. We take all reports seriously and will investigate promptly.

When reporting a violation, please include as much detail as possible, including the nature of the violation, any relevant evidence, and your contact information.

7. Enforcement

We reserve the right to investigate and take appropriate action against anyone who, in our sole discretion, violates this AUP. Actions we may take include, but are not limited to:

• Warning: Issuing a written warning identifying the violation and requesting immediate cessation.
• Content removal: Removing or disabling access to content that violates this AUP.
• Temporary suspension: Temporarily suspending your account while we investigate a potential violation.
• Account termination: Permanently terminating your account for serious or repeated violations.
• Legal action: Pursuing legal remedies, including reporting illegal activity to law enforcement authorities.

If your account is suspended or terminated due to an AUP violation, you may not be entitled to a refund for any remaining Subscription period, except as required by applicable law.

8. Copyright Complaints

We respect the intellectual property rights of others. If you believe that content stored on or accessible through BuildBase infringes your copyright, please send a written notice to [email protected] containing:

• A description of the copyrighted work you believe has been infringed.
• A description of the material you believe to be infringing, including sufficient detail for us to locate it.
• Your contact information (name, address, email, phone number).
• A statement that you have a good-faith belief that the use of the material is not authorised by the copyright owner, its agent, or the law.
• A statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorised to act on the copyright owner's behalf.
• Your physical or electronic signature.

We will investigate valid copyright complaints and take appropriate action, which may include removing the allegedly infringing content and, in the case of repeat infringers, terminating their accounts.
